Emerging Designer Diamond Initiative (EDDI) Application Terms & Condition
Natural Diamond Council (NDC)
By submitting an application, you (“Applicant”) agree to abide by these Application Terms and the decisions of The Natural Diamond Council (“NDC”) and its designees, which shall be final and binding in all respects relating to the Emerging Designer Diamond Initiative (“Initiative”).
WHO CAN SUBMIT AN APPLICATION: Applicants must be jewelry designers, 18 or older, who legally reside in the United States.
HOW TO SUBMIT AN APPLICATION: To submit an application, visit https://www.naturaldiamonds.com/council/industry-news/eddifund-app/ and follow the directions provided to complete and submit the application form in its entirety (“Application”). Limit one (1) Application per Applicant. All Applications become the property of the NDC. Information provided as part of Application must be true and verifiable and must be in English.
Applications will be accepted until the NDC has provided $1 million in diamond credits, whichever is sooner.
APPLICATION REVIEW: Applications will be reviewed on a rolling basis. NDC will determine which Applicants will receive a Diamond Credit (as described below) based, among other things, on the following: Innovative use of natural diamonds, a viable business plan, goals for business growth. Submitting an Application as part of this Initiative does not guarantee that you (or any Applicant) will receive a Diamond Credit. Diamond Credit recipients, if any, will be selected by NDC, in its sole and absolute discretion.
CREDIT RECIPIENT NOTIFICATION AND OBLIGATIONS: Potential Diamond Credit recipients will be contacted by email or telephone and will be required to execute and return a Diamond Credit Recipient Agreement within a time period specified by NDC. If such document is not returned within the specified time period, a potential Diamond Credit recipient cannot be contacted within a reasonable time period or is not in compliance with these Application Terms, such potential Diamond Credit recipient will be disqualified.
DIAMOND CREDIT: Up to a $20,000 credit to purchase diamonds from a NDC affiliated seller. Credit must be used within one year from the date provided. All federal, state and local taxes are the sole responsibility of the Diamond Credit recipients. Limit one (1) credit per Applicant. All details are at NDC’s sole discretion.
GRANT OF RIGHTS: By accepting a Diamond Credit, Diamond Credit recipients agree and hereby grant to NDC and its designees, successors, licensees and assigns an unlimited, perpetual, irrevocable, assignable, royalty-free, fully paid-up license to reproduce, distribute, create derivative works of, edit, alter, display, exhibit, combine with other materials, exploit and otherwise use the Diamond Credit recipient’s name, city and state of residence, image, and company name and logo, in connection with the Initiative, in whole or in part, in any manner and in any and all media now known or hereafter devised (including on NDC’s website and social media pages) throughout the universe for any purpose whatsoever, including, without limitation, for commercial purposes, without compensation or notification to, or permission from, entrant or any third party.
GENERAL CONDITIONS: Void where prohibited by law. Application process is subject to all applicable federal, state and local laws. By submitting an Application, Applicants agree to release, discharge, hold harmless and indemnify NDC, its parent, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind (including, without limitation, arising from claims based upon invasion of privacy, defamation, or right of publicity) to persons, including death, or property resulting, in whole or in part, directly or indirectly, from Applicant’s participation in the Application Process and/or the use of any Application, in whole or in part, in any manner by NDC in connection with the Initiative.
Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered or garbled Applications; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Initiative or the Application Process, including, without limitation, errors or difficulties which may occur in connection with the administration of the Application Process or in any Application or Initiative-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Application process or the Initiative. Released Parties are not responsible for injury or damage to any person’s computer related to or resulting from participating in this Application process or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Application process or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Application Terms, as solely determined by NDC, will be disqualified. NDC reserves the right at its sole discretion to suspend, modify or terminate the Application process at any time and for any reason. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE APPLICATION PROCESS MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, NDC RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
